Financial Statement Notes

PART X, LINE 2:

The plan obtained its latest determination letter on november 12, 2004, in which the internal revenue service (irs) stated that the plan, as then designed, was in compliance with the applicable requirements of the internal revenue code (irc) and was tax-exempt under the provisions of section 501(c)(9) of the irc as a veba. The plan is required to operate in conformity with the irc to maintain its qualification. The plan has been amended subsequent to the date of the plan's determination letter; however, the plan administrator is not aware of any events that have occurred that might adversely affect the plan's qualified status. Us gaap requires management to evaluate tax positions taken by the plan and recognize a tax liability (or asset) if the plan has taken an uncertain position that more-likely-than-not would not be sustained upon examination by the irs. The plan is subject to routine audits by taxing jurisdictions; however, there are currently no audits for any tax periods in progress.
