The CAO's compensation is determined based on comparable data from other nonprofit organizations and the deliberations/results of evaluations are documented. CAO's annual compensation is re-evaluated and consideration is given to salary increases only if certain goals, objectives and criteria are met.

Form 990, Part III, line 3

The NYS Board of Regents voted not to renew the charter of the School. The School was notified on 8/23/13 that the NYS Education Department would commence closing procedures. Accordingly, the charter school program was terminated as of said date, and the School immediately began to implement NYS education department mandated closing procedures and ceased operations as a school.

The School was notified on 8/23/13 that the NYS Education Department would commence closing procedures. Accordingly, the charter school program was terminated as of said date, and the School immediately began to implement NYS education department mandated closing procedures. Due to the abrupt closure of the school, the school's leasehold improvements in the net book value amount of $1,348,181 located at 115 Ash Street, Buffalo, NY were abandoned. The fair market value was calculated as the net book value of the leasehold improvements. Per Agreement with NYSED, Buffalo Public Schools took possession of the building in 9/2013 and operated a District school that enrolled most of the former Pinnacle students out of the school's location at 115 Ash Street for the 2013-14 school year. To accommodate this situation, the lease agreement with the landlord (AEN Properties, Inc.) was legally transferred and assigned to Buffalo Public Schools until July 31, 2014 (following the end of 2013-14 school year). The furniture and fixtures with an appraised value of $125,000 ($201,038 net book value) remained at the school's location of at 115 Ash Street for use by the Buffalo Public Schools, and per Article 56 of the NYS education law are required to be legally transferred to Buffalo Public Schools as part of the dissolution plan awaiting approval. The remaining net assets have not yet been fully liquidated, and per Article 56 of the NYS education law are expected to be transferred to Buffalo Public Schools when the school's dissolution plan is finally approved by the NYS education department and the NYS Attorney General and the appropriate NYS Court Order of Dissolution is issued.
