PART X, LINE 2:

Community services third housing corporation is an organization exempt from taxation under section 501(c)(3) of the internal revenue code. It is highly certain that some positions taken for income tax purposes would be sustained upon examination by the taxing authorities, while others are subject to uncertainty about the merits of the position taken or the amount of the position that would be ultimately sustained. The benefit of a tax position is recognized in the financial statements only to the extent that an uncertain tax position, if any, is attributable to the corporation. The tax returns for the tax years 2010 through 2013 remain subject to examination by the internal revenue service for u.s. Federal tax purposes and also by new york state for state tax purposes.

THE CORPORATION OPERATES THE ARMOR DUELLS RESIDENCE (THE RESIDENCE), A FIVE-BEDROOM GROUP HOME IN ORCHARD PARK, NEW YORK (THE PROJECT). THE PROJECT IS INSURED AND REGULATED BY THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) UNDER SECTION 811 OF THE NATIONAL AFFORDABLE HOUSING ACT. SUCH RESIDENCES ARE REGULATED BY HUD AS TO RENT, CHARGES AND OPERATING METHODS. THE CORPORATION IS SUBJECT TO SECTION 811 PROJECT RENTAL ASSISTANCE CONTRACTS WITH HUD WHEREBY HUD SUBSIDIZES THE EXCESS OF CONTRACT RENTS, AS DEFINED, OVER RENTS PAYABLE BY THE TENANTS AS DETERMINED IN ACCORDANCE WITH HUD REGULATIONS. A SIGNIFICANT PORTION OF THE CORPORATION'S RENTAL INCOME IS RECEIVED FROM HUD. LEGAL TITLE TO THE RESIDENCES IS HELD BY THE CORPORATION. THE CONTRACT EXPIRES MAY 31, 2014 AND IS SUBJECT TO RENEWAL.
