The organization has seven classes of members: realtor members, institute affiliate members, affiliate members, public service members, honorary members, student members, and life members. A description of each type of member is listed in the organizational bylaws, as well as the qualifications for each type of member and the application process to become a member.

Form 990, Page 6, Part VI, Line 7A

The governing body of the organization shall be a board of directors consisting of the elected officers, the immediate past president of the organization, and seven elected realtor members of the organization. A nominating committee of three realtor members shall be appointed by the president with the approval of the board members. The nominating committee shall select one candidate for each office and one candidate for each place to be filled on the board of directors. The nominating committee report shall be mailed to each member eligible to vote with the voting taking place at the annual meeting or electronically, if permitted.

Form 990, Page 6, Part VI, Line 7B

The bylaws may be amended by a majority vote of the members of the organization. Amendments to the bylaws affecting the admission of qualification of realtor and institute affiliate members, the use of the terms realtor and realtors, or any alteration in the territorial jurisdiction of the organziation shall become effective upon their approval as autheroized by the board of directors of the national association of realtors.

A copy of the form 990 is made available to the board of directors annually at the board meeting and is available for members upon request.

Form 990, Page 6, Part VI, Line 12C

Any member serving on the board of directors, chairperson, co-chair, committee, or task force, upon election or appointment, shall provide disclosure of any interests, memberships, or other relationships that could possibly lead to a conflict of interest or in advance of any discussion or deliberation on any issue or matter in which such conflict of interest may arise. The elkhart county board of realtors shall provide a conflict of interest disclosure statement annually to each board member and committee/task force member. In addition, all decisions under a conflict of interest shall be recorded in the minutes of the meeting. The disclosure and minutes shall include the nature and extent of the conflict, an outline of the discussion, and the actions taken to manage the conflict. Any interested member must not participate in the discussion or deliberation on the issue or matter in which the conflict of interest arises, and shall not attempt to influence the vote on that particular issue or matter. The interested member shall abstain from the vote on that issue or matter. The elkhart county board of realtors shall provide the opportunity and procedure for any interested member to officially record an abstention in the minutes of the meeting.
