Mission

TAXPAYER'S STATEMENT OF ELECTION UNDER SECTION 168(H)(6)

Taxpayer's statement of election under section 168(h)(6) of internal revenue code of 1986, as amended taxpayer makes the following election: taxpayer is a tax-exempt controlled entity (as defined in section 168(h)(6)(f)(iii) of the internal revenue code of 1986 (as amended) (hereinafter ""168""). Taxpayer elects to treat any gain recognized by its tax-exempt parent, as unrelated business taxable income under code section 511. Pursuant to 168(h)(5)(6), taxpayer elects not to be treated as a tax-exempt entity or as a successor of a tax-exempt entity. Taxpayer makes this election under the following internal revenue code: section 168(h)(6)(f)(ii) and regulation section 301.9100-7t(a)(3)(i). Taxpayer makes this election as to the following: tax period: 2019 and thereafter; property: coogan terrace limited dividend housing association limited partnership taxpayer is entitled to make this election: section 168(h)(6)(f)(ii) allows a tax-exempt controlled entity to elect to treat any gain recognized by a tax-exempt parent as unrelated business taxable income under code section 511 on any disposition of an interest in the controlled entity (including dividends or interest received or accrued from the controlled entity). The election applies for property placed in service after sept. 25th, 1985 (or earlier if so elected). Taxpayer understands that this election is irrevocable and must be made by the due date of the return for the first tax year for which the election is to be effective. Taxpayer has filed a copy of this election with its tax return and a copy of this election statement has been sent to each tax-exempt shareholder or beneficiary of taxpayer for attachment and filing to the federal tax returns (e.g. Form 990) of such tax-exempt shareholder(s) or beneficiaries.
