Each member of virginia private colleges benefits consortium shall be a "private educational institution", meaning a nonpublic, nonprofit college or university that is accredited by a nationally recognized regional accreditation body or by the board of governors of the american bar association and: - has its primary campus located within the commonwealth; - is owned or operated by a corporation, trust, association or religious institution or any subsidiary or affiliate of any such entity; - has been in existence as a private educational institution in the commonwealth for at least 10 years; - is a member in good standing of the council of independent colleges in virginia, inc.; - otherwise qualifies as an institution of higher education as defined in section 23.1-213 of the code of virginia; and - executes a membership and adoption agreement. The sponsoring association is also a member of the virginia private colleges benefits consortium.

The finance and audit committee oversees the selection of an independent auditor and assumes responsibility for the oversight of the audit of the financial statements. No changes have occurred in this process during the current year.

Financial Statement Notes

PART X, LINE 2:

The trust established under the plan constitutes a "voluntary employee beneficiary association and has obtained an exemption letter from the internal revenue service dated september 2, 2010 stating that the trust is tax-exempt under the provisions of section 501(c)(9) of the internal revenue code of 1986 (irc). The plan is also classified as a multiple employer welfare arrangement (mewa) by the department of labor (dol). Accounting principles generally accepted in the united states of america require plan management to evaluate tax positions taken by the plan and recognize a tax liability (or asset) if the organization has taken an uncertain position that more likely than not would not be sustained upon examination by the irs. The plan administrator has analyzed the tax positions taken by the plan, and has concluded that as of december 31, 2022, there are no uncertain positions taken or expected to be taken that would require recognition of a liability (or asset) or disclosure in the financial statements.
