Ott's branch elderly housing, inc. Is a not-for-profit corporation formed in accordance with the not-for-profit statutes of the state of south carolina. The corporation was formed for the purpose of operating a 10 unit community known as ott's branch elderly housing located in branchville, south carolina, which provides housing for low-income elderly persons, pursuant to section 202 of the national housing act, as amended.

Governance Explanations

The organization has entered into a management agreement with a management company for day-to-day management of the apartment community as is customary for owners/operators of hud-assisted rental communities. The management contract encompasses the day to day operations of the project including, but not limited to, collection of rents, maintenance of facilities, supervision of staff, and ongoing support for both the owners and tenants as needed in order to establish a safe, sanitary, and affordable environment.

The return is prepared by a certified public accounting firm and provided to the management company for initial review and approval. After any questions and comments from the management company are addressed, the return is provided to the board of directors for final review and approval. Additional Explanations

FORM 990, PART XI, LINE 9:

Capital advance program mortgage note 1,301,200. The corporation entered into a capital advance program mortgage note for a capital advance in the amount of $1,301,200. The note bears no interest and repayment is not required as long as the housing property remains available for low income elderly persons in accordance with section 202 of the national housing act and the prac and is operated in accordance with the regulatory agreement and hud regulations. For these reasons the note has been reclassified from an other liability to net assets in the current year.

FORM 990, PART XII, LINE 2C:

The management company receives a copy of the audit. Prior to the finalization of the audit, a copy of the audit is given to all of the board members for their comments. When the audit is up for bid, the board discusses the relationship with the current auditors and makes a determination as to whether to maintain this relationship or change to a new auditng firm.

PART X, LINE 2:

The corporation is exempt from federal income tax under section 501(c)(3) of the internal revenue code and state income tax, and has been classified as an other than private foundation. Accordingly, no provision for federal and state taxes on revenue and income has been recognized in the accompanying financial statements. Generally, the federal and state returns are subject to examination for three years after the later of the original or extended due date or the date filed with the applicable tax authority.
