Matt cottrill and mark cottrill are son and father. The father, mark cottrill, replaced the son, matt cottrill, on the board during the tax year. They were not on the board at the same time.

Lapaz garden court, inc. Is managed by bradley residential management, a professional property management company. Bradley residential management has a project owner's and management agent's certification for multifamily housing projects with the us department of housing and urban development. Under this certification, hud has approved bradley residential management to manage the lapaz garden court apartment community. The management contract encompasses the day to day operations of the project including, but not limited to, collection of rents, maintenance of facilities, supervision of staff, and ongoing support for both the owners and tenants as needed in order to establish a safe, sanitary and affordable environment.

Form 990, Part VI, Section A, Line 7A

The directors of the corporation shall at all times be limited to individuals who are either members of the garden court inc. Board of directors or nonmembers who have the approval of the board of directors of the sponsoring organization. In the event that a director of the corporation ceases to be a member of the garden court inc. Board of directors, or if the aforesaid approval is withdrawn, then in either event such shall constitute automatic resignation as a director of the corporation.

The auditing firm sends a draft of the return to the management company. The management company presents the 990 at the board meeting for their review. Once the board has an opportunity to ask questions, the board approves the form 990 and the president gives appproval to file the return.

Overview of audit function: the management company receives a copy of the audit. Prior to the finalization of the audit, a copy of the audit is given to all of the board members for their comments. When the audit is up for bid, the board discusses the relationship with the current auditors and makes a determination as to whether to maintain this relationship or change to a new auditing firm.

PART X, LINE 2:

The corporation is exempt from federal income tax under section 501(c)(3) of the internal revenue code and state income tax and has been classified as an other than private foundation. Accordingly, no provision for federal and state taxes on revenue and income has been recognized in the accompanying financial statements. Generally, the federal and state tax returns were subject to examinations from the three years after the later of the original or extended due date or the date filed with the applicable tax authority.

THE CORPORATION HAS EXECUTED A REGULATORY AGREEMENT WITH HUD WHICH GOVERNS THE OPERATION OF THE COMMUNITY WITH THE FEDERAL HOUSING ADMINISTRATION (FHA) SECTION OF HUD. THE CORPORATION HAS ALSO ENTERED INTO A PROJECT RENTAL ASSISTANCE CONTRACT (PRAC CONTRACT) WITH HUD. THE PRAC CONTRACT IS A RENT ASSISTANCE PROGRAM FOR LOW-INCOME FAMILIES (OR PERSONS) AS PROVIDED BY THE SECTION 8 PROGRAM OF THE NATIONAL HOUSING ACT.
