“Members are made up of breweries and trade allies. Craft brewery members may vote on association matters. Allied members, wholesale members, enthusiast members, and brewery-in-planning members are all non-voting.”

The board shall review each member questionnaire and any other disclosures regarding financial interests of its members. After disclosure of the financial interest, the interested person shall leave the board meeting while the remaining board members discuss and vote on whether a conflict of interest exists. After exercising due diligence, the governing board or committee shall determine whether the organization can obtain with reasonable effort a more advantageous transaction or arrangement from a person or entity that would not produce a conflict of interest. WE ALSO HOSTED A STATEHOUSE DAY ATTENDED BY MORE THAN 60 BREWERY OWNERS AND EMPLOYEES AND CONTINUED ADVOCATING FOR HOUSE BILL 306 AND SENATE BILL 138 WHICH ARE STILL IN THEIR RESPECTIVE COMMITTEES. IF SUCCESSFUL, EITHER OF THESE BILLS WOULD REMOVE BREWERIES WHO PRODUCE FEWER THAN 250,000 BARRELS OF BEER PER YEAR FROM THE DEFINITION OF MANUFACTURERS TO WHOM FRANCHISE LAW APPLIES. THE CHANGE WOULD COVER ALL BUT OUR LARGEST BREWERY MEMBER AND ENABLE BREWERIES TO DIRECTLY NEGOTIATE THEIR CONTRACTS WITH WHOLESALE BEER DISTRIBUTORS OUTSIDE OF THE CONFINES OF FRANCHISE LAW WHICH REQUIRES AUTOMATICALLY RENEWING CONTRACTS AND PROVING "JUST CAUSE" IN A COURT OF LAW TO OTHERWISE TERMINATE THE RELATIONSHIP. |
