Governance Explanations

Form 990, Part VI, Section A, line 6

The regular members of the scclt, with full voting rights, shall be: (1) the lessee members - all persons who lease land or housing from the scclt and are 18 years of age or over. (2) the general members - all other persons, 18 years of age or older, who have complied with the following requirements: a. Pay annual membership dues as established by the board for the current calendar year and support the general principals of the scclt. B. Dues shall be waived for general members who are participants in other home ownership programs administered by the state college borough. (3) public members - the three members of the municipal council of the borough of state college, or their appointees, who are serving on the board of directors of the scclt as public representatives. Public members are subject to the same requirements as general members listed in (2) above and in (4) below. (4) to maintain regular membership a person must either be a leasee member or: a. Show a continuing interest in the scclt and its purposes; and b. Have paid dues established for the current calendar year

Every member has the right to participate in the election of six members of the board of directors.

Action taken by the board of directors on any motion for the sale of land, alteration of the resale formula, removal of directors, or dissolution of the scclt shall not become effective unless approved by the majority of the members.

The 990 is reviewed and approved by the finance committee before it is filed with the irs. The full board also receives a copy.

Board members are required to complete a conflict of interest statement annually. These statements are reviewed and maintained by the executive director. The conflict of interest policy does mention family and business relationships as a source for potential conflicts.

Scclt accounts for uncertainty income taxes using a recognition threshold of more likely than not to be sustained upon examination by the appropriate taxing authority. Measurement of the tax uncertainty occurs if the recognition threshold is met. Managment determined there were not tax uncertainties that met the recognition threshold.

WHEN THE INDIVIDUAL COMES IN FOR AN ORIENTATION, THEY WILL RECEIVE AN APPLICATION TO COMPLETE SO SCCLT CAN CONFIRM THE INDIVIDUAL'S ELIGIBILITY FOR THIS PROGRAM. SCCLT HOMES ARE SOLD TO PEOPLE WITH QUALIFIED INCOMES WHO HAVE NOT OWNED A HOME FOR THE PAST THREE YEARS. HOMEOWNERS PURCHASE THE HOME, BUT LEASE THE LAND IN A LONG-TERM AGREEMENT FROM THE SCCLT. BY TAKING THE COST OF THE LAND OUT OF THE SALE, SCCLT HOMES ARE MORE AFFORDABLE THAN HOMES SOLD ON THE OPEN MARKET.
