“The internal revenue service (irs) has threatened to levy penalties in the amount of $1.4m against the organization related to payroll reporting discrepancies. The organization had previously engaged a service provider to file the required payroll reports at issue, and as such, is now pursuing indemnification from that provider to cover any penalties ultimately imposed as well as fees and related expenses associated with attempting to resolve the threatened penalties. The organization has also engaged legal and accounting firms to work with the irs to resolve the issue. The threatened levy is neither reflected as an expense in the tax return nor as a liability in the balance sheet.”
