THERE WERE TWO LAWSUITS IN ACTIVE LITIGATION DURING THAT TIME.SHAW V. BURKE, ET AL., CIVIL ACTION NO. 17-2386 (C.D. CAL.): THIS WAS A CIVIL RIGHTS LAWSUIT BY PLAINTIFF COLLEGE STUDENT RAISING FIRST AMENDMENT CLAIMS AGAINST ADMINISTRATORS AT HIS COMMUNITY COLLEGE AND THE BOARD OF TRUSTEES OF THE COMMUNITY COLLEGE DISTRICT. THE CLAIMS CHALLENGED DISTRICT AND COLLEGE-LEVEL POLICIES LIMITING STUDENT EXPRESSIVE ACTIVITY AND DISTRIBUTION OF LITERATURE ON CAMPUS. THE CHALLENGED POLICIES IMPACTED OVER 20,000 STUDENTS AT THE COLLEGE AND ROUGHLY 150,000 STUDENTS IN THE DISTRICT. A SETTLEMENT AGREEMENT WAS REACHED IN DECEMBER 2018. DEFENDANTS AGREED TO ENACT POLICY CHANGES AT THE COLLEGE AND DISTRICT LEVEL THAT HAD A BROAD IMPACT ON STUDENT EXPRESSIVE RIGHTS THROUGHOUT THE LARGEST COMMUNITY COLLEGE DISTRICT IN THE COUNTRY, PROMOTING FIRE'S MISSION TO DEFEND AND SUSTAIN FREEDOM OF SPEECH AT AMERICA'S COLLEGES AND UNIVERSITIES. DEFENDANTS ALSO AGREED TO PAY $225,000 IN ATTORNEY'S FEES FOR THE WORK OF FIRE STAFF ATTORNEYS AND OUTSIDE CO-COUNSEL IN THE CASE.FIRE V. REGENTS OF THE UNIVERSITY OF CALIFORNIA, ET AL., CASE NO. 19STCP01033 (SUPER. CT. CAL.): THIS LAWSUIT WAS FILED UNDER THE CALIFORNIA PUBLIC RECORDS ACT SEEKING TO COMPEL THE RELEASE OF DOCUMENTS REQUESTED BY FIRE RELATED TO A CAMPUS SPEAKING APPEARANCE AT UCLA BY SECRETARY OF THE TREASURY STEVEN MNUCHIN, AND ALLEGING A PATTERN AND PRACTICE BY UCLA OF UNREASONABLY DELAYING THE RELEASE OF DISCLOSABLE RECORDS IN VIOLATION OF THE ACT. THE SUIT FURTHERS FIRE'S INTERESTS AS A PUBLIC INTEREST WATCHDOG ORGANIZATION THAT VIGOROUSLY PURSUES PUBLIC RECORDS, MADE ACCESSIBLE BY STATE STATUTE, AS A MEANS OF HOLDING PUBLIC INSTITUTIONS ACCOUNTABLE FOR THEIR ACTIONS. |
